TERMS OF SERVICE
H&R Landscaping and Grading
Welcome to H&R Landscaping and Grading (“Company”, “we”, “us”, “our”). We provide landscaping and grading services as outlined in these Terms of Service (“Terms”). By engaging with us for services, you (“Client”, “you”, “your”) agree to be bound by these Terms. Please read them carefully.
Services Provided
1. We offer a variety of landscaping and grading services, which may include but are not limited to, lawn care, planting, hardscape installation, land grading, and drainage solutions. The specific services to be provided will be detailed in your Service Agreement.
Service Agreements
2. All services are performed under a Service Agreement detailing the scope of work, pricing, and timeline established between the Company and the Client before the commencement of any services.
3. Changes to the Service Agreement must be made in writing and agreed upon by both parties.
Pricing and Payment
4. Prices for our services are provided in the Service Agreement and may vary based on the scope and complexity of the project.
5. Payment terms shall be outlined in the Service Agreement. Generally, a deposit is required before commencement of services, with the balance due upon completion. Late payments may incur additional charges.
6. Pricing is subject to change for additional work not specified in the initial Service Agreement or for unforeseen complications that require additional labor or materials.
Scheduling and Timing
7. Work scheduling will be coordinated in advance with the Client. The Company will make every reasonable effort to adhere to the agreed schedule. However, delays may occur due to weather conditions, availability of materials, or other unforeseen circumstances.
8. The Company cannot guarantee exact start or completion dates but will endeavor to communicate any changes in the schedule in a timely manner.
Site Access and Condition
9. The Client is responsible for ensuring the Company has access to the work area for the duration of the services.
10. The Client agrees to have the site free from any hindrances or hazardous materials that were not disclosed at the time the Service Agreement was made.
Client Responsibilities
11. The Client is responsible for obtaining any necessary permits or approvals required for the service work prior to the commencement of services.
12. The Client must disclose the location of underground utilities, property lines, and any other obstructions that may affect the work to be performed.
Company Responsibilities
13. The Company agrees to perform all services in a professional manner, consistent with industry standards.
14. We will take reasonable precautions to minimize any disruptions to your property and to leave the work area in a tidy state upon completion of services.
Cancellation Policy
15. Either the Company or the Client may cancel the services by providing written notice to the other party in accordance with the termination provisions outlined in the Service Agreement.
16. Any deposits or payments made may be non-refundable as per the cancellation terms specified in the Service Agreement.
Warranty and Limitation of Liability
17. The Company warrants that services will be performed to a professional standard. Any claims for warranty service must be made within a period specified in the Service Agreement. This warranty does not cover damages due to normal wear and tear, improper use, or maintenance by the Client.
18. The Company’s liability for damages, regardless of the form of the action, shall be limited to the total amount paid by the Client for the services rendered.
Dispute Resolution
19. Any disputes arising from these terms or services provided shall be resolved through negotiation. If a resolution cannot be reached, either party may seek final resolution through binding arbitration or in a court of competent jurisdiction.
Updates to Terms
20. We reserve the right to update or modify these Terms at any time. We will notify Clients of significant changes to the Terms and continue to provide services according to the revised Terms unless otherwise agreed upon.
